By completing and submitting this form, you (the “Submitter”) grant Bogart Radio (and its affiliated platforms, including the Bogart Radio app) the non-exclusive, perpetual right to stream, broadcast, distribute, and promote your submitted musical work. This includes airplay on Bogart Radio’s live broadcast, inclusion in the Bogart Radio app, and placement in the “Bogart Top 100” chart. Furthermore, Bogart Radio will report play counts to SAMRO to ensure accurate royalty payments to rights holders.

2. Rights Grant & License:
By checking the acceptance box below, I, the Submitter, certify that I own or have secured all necessary rights to the submitted track. I grant Bogart Radio a non-exclusive, perpetual license to:
* Stream and broadcast the track on Bogart Radio’s live programming.
* Distribute the track via the Bogart Radio app, including featuring it in the “Bogart Top 100” chart.
* Collect and report play counts to SAMRO for royalty distribution.
3. Warranties and Representations:
I represent and warrant that the submitted track is wholly original, or that I have obtained all necessary licenses and permissions for its use. The track does not infringe any copyright, trademark, or any other third-party rights. I understand that all plays, whether on-air or in the app, will be accurately reported to SAMRO and used exclusively for the purpose of calculating royalties.
4. Compensation & Chart Participation:
I acknowledge that my participation in the “Bogart Top 100” chart is purely based on the number of plays, both on the radio and in the app, and does not guarantee any monetary compensation from Bogart Radio. I understand that any royalties owed will be handled exclusively by SAMRO, and Bogart Radio is not responsible for additional payments.
5. Duration of Use:
I understand and agree that this authorization is perpetual. Bogart Radio reserves the right to keep the track in rotation, archive it in the app, or remove it in the future at their discretion.
